Terms and Conditions

By accessing or using Pruvn, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 13 years old to create an account on Pruvn. In the European Economic Area and United Kingdom, the minimum age is 16. In India, the minimum age for account creation involving personal data processing is 18.
• During account registration, you will be asked to confirm your age. Providing a false age constitutes a violation of these Terms and may result in immediate account termination.
• Individuals below the minimum age may browse published stories without creating an account. Account creation, claim submission, community notes, and other interactive features require an account and therefore require meeting the minimum age.
• If you are using the Service on behalf of an organization, you represent that you are at least 18 years old and have the authority to bind that organization to these Terms.
• We reserve the right to refuse service, terminate accounts, or restrict access at our sole discretion, including accounts suspected of belonging to underage users.

2. Account Registration and Security

• You may create an account using your phone number via OTP verification.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or are suspected of fraudulent activity.
• One person may maintain only one active user account. Multiple accounts for the same individual may be merged or terminated.

3. Description of Service

Pruvn is a fact-checking platform that enables:

• For consumers: Access to verified news stories, ability to submit claims for fact-checking, share verified content on messaging platforms, and contribute community notes.
• For fact-checking organizations: Tools to receive claims, research them using AI assistance, publish fact-check verdicts, and distribute corrections via WhatsApp and other channels.
• For news portals: Integration of fact-checked content via APIs, embeddable widgets, and white-label solutions.

The Service is provided "as is" and "as available." We make no warranty that the Service will be uninterrupted, error-free, or available at all times.

4. User Conduct

You agree NOT to:

• Submit false, misleading, or fraudulent claims with the intent to manipulate fact-checking resources.
• Impersonate any person or organization, or misrepresent your affiliation.
• Upload or transmit content that is illegal, defamatory, abusive, hateful, obscene, or violates any third party's rights.
• Attempt to gain unauthorized access to our systems, servers, databases, or other users' accounts.
• Use automated scripts, bots, or scrapers to access the Service without our written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for any political campaigning, propaganda, or election manipulation.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Circumvent any access controls, rate limits, or security measures.
• Resell, redistribute, or commercially exploit the Service without a valid agreement.

5. Content and Intellectual Property

5.1 Our Content

The Service, including its design, code, branding, logos, text, graphics, and software, is the property of Whizzybase Technologies Private Limited and is protected by copyright, trademark, and other intellectual property laws. "Pruvn", "PruvnLabs", "Share only once proven.
Privacy · Terms · Delete Account · Contact, and the Pruvn shield logo are trademarks of Whizzybase Technologies Private Limited.

5.2 User Content

You retain ownership of content you submit (claims, community notes, feedback). However, by submitting content to Pruvn, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, modify, display, distribute, and create derivative works from your content in connection with the Service. This license survives account deletion for content that has been published or used in fact-checks.

5.3 Organization Content

Fact-checking organizations that publish stories through Pruvn retain ownership of their editorial content. By publishing through the platform, organizations grant Pruvn a license to display, distribute, and share their stories through the Pruvn network, including on WhatsApp, social media, and partner websites. Organizations may request removal of their published content by contacting us.

5.4 Fact-Check Verdicts

Fact-check verdicts published on Pruvn represent the editorial judgment of the publishing organization, not of Whizzybase Technologies Private Limited. We do not endorse, guarantee, or take responsibility for the accuracy of any fact-check verdict. Users should exercise their own judgment.

6. Subscriptions and Payments

6.1 Free Tier

Basic access to the Pruvn platform is provided free of charge for both consumers and organizations (subject to usage limits).

6.2 Paid Plans

We offer paid subscription plans (Pro, Newsroom, Enterprise) with enhanced features, higher limits, and priority support. Pricing is published on our website and may change with 30 days' notice to existing subscribers.

6.3 Payment Terms

• Subscriptions are billed monthly or annually as selected.
• Payments are processed through third-party payment providers. We do not store credit card or bank account details on our servers.
• Failed payments may result in downgrade to the free tier after a 7-day grace period.
• No refunds are provided for partial months or unused features, except as required by applicable law.

6.4 Taxes

All prices are exclusive of applicable taxes (GST in India, VAT in the EU/UK). Taxes will be added where required by law.

7. API Usage

If you access the Pruvn API (available on paid plans), you agree to:

• Use the API only for lawful purposes consistent with these Terms.
• Not exceed the rate limits associated with your plan.
• Not use the API to build a competing service.
• Attribute Pruvn as the data source in any public-facing application using our API.
• Keep your API credentials confidential and not share them with unauthorized parties.

We reserve the right to throttle, suspend, or revoke API access for violations of these terms or excessive usage.

8. Chrome Extension

The Pruvn Chrome Extension operates within your browser and:

• Only accesses webpage content when you explicitly trigger an action (Add Evidence, Create Story, AI Summarize).
• Does not collect browsing history, passwords, or personal data from pages you visit.
• Requires authentication with your Pruvn admin account to function.
• Communicates only with pruvnlabs.com servers and does not send data to any other third party.

9. WhatsApp Bot

Our WhatsApp bot allows users to submit claims for fact-checking. By messaging our bot:

• You consent to your message being processed for fact-checking purposes.
• Your phone number is used solely for responding to your query and is not shared with third parties for marketing.
• Responses are generated based on our database and AI tools and should not be considered legal, medical, or professional advice.

10. Disclaimer of Warranties

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Whizzybase Technologies Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill.
• Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or INR 5,000 (whichever is greater).
• We are not liable for the accuracy, completeness, or reliability of any fact-check verdict published by third-party organizations on our platform.
• We are not liable for actions you take based on information obtained through the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless Whizzybase Technologies Private Limited, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third party's rights.

13. Governing Law and Dispute Resolution

• Governing Law: These Terms are governed by the laws of India, without regard to conflict of law principles.
• Jurisdiction: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Jammu, India.
• Arbitration: Before filing any legal action, the parties agree to attempt to resolve disputes through good-faith negotiation for 30 days, followed by binding arbitration under the Arbitration and Conciliation Act, 1996, conducted in Jammu, India, in English.
• EU/UK Users: Nothing in these Terms affects your statutory rights under the applicable consumer protection laws of your country of residence. You may bring claims in your local courts.
• US Users: You agree to resolve disputes through individual arbitration and waive the right to participate in class actions, to the extent permitted by law.

14. Termination

• You may terminate your account at any time by contacting us or using the account deletion feature.
• We may terminate or suspend your account immediately, without prior notice, for violations of these Terms.
• Upon termination, your right to use the Service ceases immediately. Data retention is governed by our Privacy Policy.
• Sections 5, 10, 11, 12, 13, and 16 survive termination.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide at least 15 days' notice of material changes via email, in-app notification, or prominent posting on our website. Your continued use of the Service after the effective date of changes constitutes acceptance. If you do not agree with the modified Terms, you must stop using the Service and delete your account.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.
• Force Majeure: We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, government actions, internet outages, or pandemics.
• Notices: We may send notices to you via email, in-app notifications, or by posting on our website. You may send notices to us at legal@pruvnlabs.com.

17. Specific Terms for Fact-Checking Organizations

If you use Pruvn as a fact-checking organization:

• You are solely responsible for the accuracy and editorial integrity of the fact-checks you publish.
• You agree to adhere to the principles of nonpartisanship, transparency, and methodological rigor in your fact-checking work.
• You must clearly disclose your organization's funding sources, methodology, and corrections policy on your organization's profile or website.
• You may not use the Pruvn platform to publish content that constitutes propaganda, political advocacy, or commercial promotion disguised as fact-checking.
• We reserve the right to remove content or suspend organizations that violate these standards.

18. Open Source and Attributions

Pruvn uses certain open-source libraries and tools. Attributions and license information for these components are available within the application and on our GitHub repository (when published). Use of open-source components is governed by their respective licenses.
